　　男子婚内出轨赠与第三者50万元

　　法院：赠与行为无效连本带利返还

　　丈夫婚内将夫妻共同财产赠与第三者，妻子能要求第三者返还所得财产吗？昨日，记者从南海法院了解到，法院近日就审理了一起类似的赠与合同纠纷案件，认定赠与行为无效。

　　唐某(男)在与黄某(女)婚姻存续期间，与小芬(女，化名)保持不正当男女交往，并多次通过微信、支付宝及银行转账方式将夫妻共同财产赠与小芬。黄某发现此事后，向法院提起诉讼，请求法院确认唐某对小芬的赠与行为无效，并要求小芬返还夫妻共同财产及利息。

　　法院经审理查明，唐某在与小芬交往期间，多次向小芬转账大额款项，合计73万元。剔除小芬向唐某转账金额合计23万元，两人之间转账差额为50万元。

　　法院认为，唐某违反夫妻忠实义务，擅自将夫妻共同财产赠与小芬，不仅侵犯了配偶的合法权益，也违背公序良俗。根据《中华人民共和国民法典》及2025年2月1日起施行的《最高人民法院关于适用〈中华人民共和国民法典〉婚姻家庭编的解释(二)》等规定，法院依法判决确认唐某赠与小芬财产的行为无效，小芬应返还款项50万元及利息。

　　根据《中华人民共和国民法典》第1043条规定，夫妻应当互相忠实，互相尊重，互相关爱。婚姻关系存续期间，夫妻一方为重婚、与他人同居以及其他违反夫妻忠实义务等目的，私自将夫妻共同财产赠与他人，不仅侵害了夫妻共同财产平等处理权，严重违背公序良俗，更是与社会主义核心价值观背道而驰。2025年2月1日起施行的《最高人民法院关于适用〈中华人民共和国民法典〉婚姻家庭编的解释(二)》明确以违背公序良俗为目的处分夫妻共同财产的行为无效，权益受到侵害的夫妻一方，主张返还全部财产的，人民法院应予支持。(广州日报全媒体记者刘艺明通讯员金磊)
